These Terms and Conditions (“Terms”) govern your use of the NursePathway NZ website (www.nursepathwaynz.com) and your purchase of any coaching service, toolkit, or digital product offered by NursePathway NZ (“we”, “us”, “our”). By purchasing a service, downloading a resource, or using this website, you (“you”, “the client”, “the nurse”) agree to be bound by these Terms.

1. About NursePathway NZ

NursePathway NZ provides career coaching, professional development guidance, and educational resources for registered and enrolled nurses in New Zealand, including but not limited to NCNZ recertification audit support, professional portfolio (PDRP) coaching, return-to-practice guidance, support for internationally qualified nurses, new graduate guidance, and CV and career coaching.

NursePathway NZ is operated by an individual New Zealand registered nurse and is not affiliated with, endorsed by, or acting on behalf of Te Kaunihera Tapuhi o Aotearoa – the Nursing Council of New Zealand (NCNZ), Te Whatu Ora – Health New Zealand, or any employer, PDRP programme, or professional body.

2. Nature of Our Services

2.1 Educational and coaching support only. NursePathway NZ provides coaching, structure, templates, feedback, and educational guidance. We do not write, complete, or ghostwrite reflective practice content, competency assessments, portfolios, CVs, or any other material that is submitted to the Nursing Council, an employer, or any other party on your behalf.

2.2 Your own work. All reflective accounts, competency evidence, portfolios, CVs, and other submitted material must represent your own authentic practice, reflection, knowledge, and professional experience. You remain solely responsible for the accuracy, honesty, and completeness of anything you submit to NCNZ, an employer, or any other third party.

2.3 No guaranteed outcomes. We do not guarantee any particular outcome, including but not limited to a successful NCNZ recertification audit, Annual Practising Certificate (APC) renewal, PDRP portfolio approval, job offer, or interview outcome. Outcomes depend on factors outside our control, including your own evidence, the requirements of third-party bodies, and decisions made by employers or NCNZ.

2.4 Not legal, regulatory, or immigration advice. Nothing provided by NursePathway NZ constitutes legal, immigration, or regulatory advice. For matters relating to registration, scope of practice, or disciplinary processes, you should refer to NCNZ directly or seek appropriately qualified advice.

3. Services and Pricing

Current services and pricing are listed on our Pricing page and may be updated from time to time. The price and inclusions applicable to your purchase are those displayed at the time you place your order. Our services currently include:

• NCNZ Recertification Toolkit – self-guided digital toolkit
• Professional Portfolio Coaching – coached PDRP portfolio support
• Professional Portfolio Toolkit – self-guided digital toolkit
• CV Starter Bundle – self-guided digital CV guide
• Career Coaching Package – coached CV, cover letter, and interview support

We may introduce, withdraw, or amend services and pricing at any time. Changes will not affect an order already confirmed and paid for.

4. Digital Toolkits (DIY Products)

4.1 Delivery. Digital toolkits (including but not limited to the NCNZ Recertification Toolkit, Professional Portfolio Toolkit, and CV Starter Bundle) are delivered electronically, typically by instant download or by email, following successful payment.

4.2 Personal use only. Digital toolkits, templates, and resources are licensed for your own personal, non-commercial use only. You may not resell, redistribute, publish, or share these materials with any other person or organisation without our prior written consent.

4.3 Refunds on digital products. Because digital toolkits are delivered instantly and can be copied or used immediately, we are unable to offer refunds once a toolkit has been downloaded or delivered, except where required by New Zealand consumer law (see clause 8) or where a genuine technical fault prevents access and we are unable to resolve it within a reasonable time.

5. Coaching Packages

5.1 Booking. Coaching sessions are booked by appointment. Please provide accurate contact information so we can confirm your booking.

5.2 Rescheduling. If you need to reschedule a session, please give us at least 48 hours’ notice where possible. We will do our best to accommodate a new time.

5.3 Cancellations and missed sessions. Cancellations made less than 24 hours before a scheduled session, or sessions you do not attend without reasonable notice, may not be eligible for a refund or rescheduled session at no charge, at our discretion.

5.4 Refunds on coaching packages. If you cancel a coaching package before any session has been delivered, you are entitled to a refund, less any reasonable administration cost already incurred. Once a session has been delivered, that portion of the package is non-refundable, except where required by New Zealand consumer law.

5.5 Email support. Where a package includes email support between sessions, this is intended for reasonable, relevant questions related to the service purchased and is provided at our discretion within a reasonable response time.

6. Payment

Payment is processed through our third-party payment providers (currently Stripe and/or PayPal). We do not directly collect or store your full card details. By making a payment, you also agree to the applicable terms of our payment provider. All prices are in New Zealand dollars (NZD) unless otherwise stated, and include or exclude GST as indicated at checkout.

7. Intellectual Property

All templates, checklists, guides, written content, and materials provided by NursePathway NZ remain the intellectual property of NursePathway NZ. You are granted a limited, personal, non-transferable licence to use these materials for your own nursing career and registration purposes. Reproduction, resale, or distribution of our materials, in whole or in part, is not permitted without our prior written consent.

8. Your Rights Under New Zealand Law

Nothing in these Terms limits or excludes any rights you have under New Zealand law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, which may apply in addition to these Terms where you are acquiring our services as a consumer.

9. Limitation of Liability

To the maximum extent permitted by law, NursePathway NZ’s total liability to you arising out of or in connection with any service is limited to the amount you paid for that service. We are not liable for any indirect, incidental, or consequential loss, including loss of income, employment opportunity, or registration outcome, arising from your use of our services or materials.

10. Confidentiality

Any personal or professional information you share with us during coaching sessions or in support of your portfolio or audit preparation will be treated as confidential and used only for the purpose of providing the service to you, in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. The version published on our website at the time of your purchase will apply to that purchase. Continued use of our website after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of New Zealand, and any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand.
